Terms and Conditions
As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to ensure that they contain everything you expect. If you are unsure about anything, call us on 01403 888276.
Application
1. These Terms and Conditions apply to the purchase of goods by you, the Customer.

3. By placing an order, you agree to these Terms and Conditions. You may only purchase goods from our website if you are eligible to enter into a contract and are at least 18 years old.
Interpretation
4. Consumer means an individual acting outside their trade, business, craft or profession.
5. Contract means the legally binding agreement between you and us for the supply of goods.
6. Delivery Location means the address for delivery set out in the order.
7. Durable Medium means any medium that allows information to be retained and reproduced unchanged.
8. Goods means the products advertised on the website that we supply to you.
9. Order means the order you submit through the website.
10. Privacy Policy means our policy on the handling of personal information.
11. Website means www.alienhydroponics.co.uk and www.easyfeed.co.uk.
Goods
12. Descriptions of goods are as set out in our advertising. Small variations in size or colour may occur.
13. If you provide specifications for custom goods, you are responsible for ensuring accuracy.
14. Goods are subject to availability.
15. We may make changes to goods where required by law or safety rules. You will be informed of any such changes.
Personal information
16. We handle personal information in line with our Privacy Policy.
17. You agree that we may contact you via email, electronic communication or post.
Basis of sale
18. The website does not constitute an offer to sell. We may reject orders.
19. You must check your order for accuracy before submitting it.
20. A contract is formed only when we send an order confirmation email.
21. Quotations are valid for 14 days unless withdrawn earlier.
22. Contract variations must be agreed in writing.
23. These Terms and Conditions are written for Consumer sales. If you are a business customer, you must inform us so that we can apply the correct terms for you. Contracts are governed by English law and the English courts have jurisdiction.
Price and payment
24. Prices are those shown on the website at the time of order unless agreed otherwise.
25. Prices include VAT for UK customers.
26. You must pay when submitting your order. We may take payment before delivery.
Delivery
27. We will deliver the Goods to the Delivery Location within the agreed period or, if no period is agreed, within 30 days for orders placed by Consumers in the UK or EU. This delivery period does not apply to business customers or to international orders outside the UK and EU. Delivery timeframes for business customers and for non EU destinations are estimates only. Customs checks may extend delivery times for international shipments, and such delays do not create any right to cancel for business customers.
28. If delivery is late, you may treat the contract as ended if conditions in the original terms are met.
29. If you end the contract for late delivery, we will refund all payments.
30. If goods are delivered despite late delivery rights, you may still reject them.
31. If goods form a commercial unit, you must cancel or reject the full unit.
32. Delivery outside the UK may involve duties or taxes that you must pay.
33. We may deliver in instalments.
34. If you fail to take delivery, we may charge storage and redelivery costs.
35. Goods become your responsibility upon delivery. You should inspect goods upon arrival.
Risk and title
36. Risk passes to you when goods are delivered.
37. Ownership passes only when full payment is received. If payment is overdue, we may recover goods.
Withdrawal, cancellation and returns
38. You may withdraw your order before the contract is formed.
39. If at our discretion we accept a return from a B2B Customer, a restocking fee of 21 percent applies to any non custom order you request to cancel or return, even if the goods remain in our possession.
40. Custom orders require a 50 percent deposit and full payment before shipping. Cancellation of custom orders incurs a fee of 50 percent of the total order value, even if the goods remain in our possession.
Consumer cancellation rights
41. For Consumers only, distance selling cancellation rights apply. Business customers do not receive these rights under UK or EU law.
42. The Consumer cancellation right lasts 14 days from the day the Consumer receives the goods.
43. Cancellation instructions must be clear and sent via a durable medium.
44. Consumers must return goods at their own cost unless we agree otherwise.
Limitations on cancellation rights
45. Consumer cancellation rights do not apply to goods made to specification, personalised goods, cut pipework, goods that have been installed or goods filled with water.
46. Rights also end if goods have been mixed inseparably with other items after delivery.
Effects of cancellation
47. If a Consumer cancels, we will refund the cost of goods but not delivery costs.
48. We may deduct for handling that reduces the value of goods.
49. Refunds are made within 14 days of receiving returned goods.
50. Consumers must return goods within 14 days of cancellation.
Meaning of distance contract
51. Definitions remain as set out in the original terms.
Conformity and guarantee
52. We must supply goods in conformity with the contract.
53. Goods must be of satisfactory quality, fit for purpose and match their description.
54. Faults arising from your materials are not our responsibility.
55. Manufacturer guarantees apply where provided.
56. We offer after sales support for installation and activation.
B2B terms
57. Business customers do not have a statutory 14 day cancellation right.
58. Any return or cancellation for business customers is accepted only at our discretion.
59. Where we allow a B2B return, a restocking fee of 21 percent will apply.
60. Any discretionary return period for B2B customers runs from the date of dispatch, not the date of delivery.
61. Goods shipped internationally may experience customs delays. These delays do not create a right to cancel or reject goods for business customers. The buyer is responsible for import clearance.
Successors and sub contractors
62. Either party may transfer benefits of the contract. We remain responsible for sub contractors.
Circumstances beyond control
63. If performance is affected by events beyond reasonable control, obligations are suspended while the event continues. This does not affect statutory rights.
